If you Private Information was potentially compromised as a result of the targeted cyberattack on Fort Wayne Medical Education Program i/s/h/a Fort Wayne Medical Society Foundation, Inc. d/b/a Fort Wayne Medical Education Program's (“FWMEP”) computer systems that occurred in December 2024 (the “Data Incident”) and you are included on the Settlement Class List, you may be a Class Member and eligible for Settlement Benefits. Excluded from the Settlement Class are: (i) the Judge assigned to evaluate the fairness of this Settlement, Court personnel and any members of their immediate families; (ii) FWMEP, and any entity in which FWMEP has a controlling interest, is a parent or subsidiary, or which is controlled by FWMEP, and the affiliates, legal representatives, attorneys, heirs, predecessors, successors and assigns of FWMEP; and (iii) any other person found by a court of competent jurisdiction to be guilty under criminal law of initiating, causing, aiding or abetting the criminal activity occurrence of the Incident or who pleads nolo contendere to any such charge.

If you are a Class Member and wish to receive Settlement Benefits then you must submit a claim form by October 27, 2026.

FWMEP has agreed to pay for a number of Class benefits, which are explained below. All Class Members are eligible to claim either Credit Monitoring Services or Medical Monitoring Services, and/or one or more cash payments.

Credit Monitoring Services. All Group 1 Class Members, are eligible to claim two (2) years of CyEx Financial Shield Complete. This comprehensive service comes with $1 million of financial fraud insurance, and includes monitoring for:

  • fraud or identity theft

  • unauthorized financial transactions

  • personal information associated with high-risk transactions

If anything suspicious happens, you will be able to talk to a fraud resolution agent to help fix any problems.

Medical Monitoring Services. All Group 2 Class Members, are eligible to claim two (2) years of CyEx Medical Shield Complete. This comprehensive service comes with $1 million of medical identity theft insurance, and includes monitoring for:

  • healthcare insurance ID exposure

  • Medical Record Number (MRN) exposure

  • unauthorized Health Savings Account (HSA) spending

If anything suspicious happens, you will be able to talk to a fraud resolution agent to help fix any problems.

Reimbursement for Lost Time. Class Members who spent time responding to the Data Incident may claim up to four (4) hours, at $20.00 per hour, for a maximum of $80.00. The amount you claim for Lost Time will count toward the $500.00 Ordinary Out-of-Pocket Losses cap. You must have spent the time on tasks related to the Data Incident. Some examples include things like:

  • changing your passwords

  • investigation suspicious activity in your accounts

  • researching the Data Incident

Reimbursement for Ordinary Out-of-Pocket Losses. Class Members who incurred actual, documented out-of-pocket expenses due to the Data Incident, can get back up to $500.00. The losses must have occurred between December 12, 2024, and October 27, 2026, and cannot have already been reimbursed by a third party. This benefit covers out-of-pocket expenses like:

  • fees for credit reports, credit monitoring, or freezing and unfreezing your credit

  • cost to replace your IDs

  • postage to contact banks by mail

Reimbursement for Extraordinary Out-of-Pocket Losses. Class Members who lost money because of identity theft or fraud, can get back up to $5,000.00. The losses must have occurred between December 12, 2024, and October 27, 2026, and cannot have already been reimbursed by a third party. This benefit covers actual, documented, and unreimbursed monetary loss of an extraordinary nature like:

  • the theft or fraud was more likely than not caused by the Data Incident

  • the losses are not already covered by Out-of-Pocket Expenses

  • you tried to prevent the loss or get your money back, such as by using insurance you already have

If you are claiming for Ordinary Out-of-Pocket Losses and/or Extraordinary Out-of-Pocket Losses, you need to submit proof, like receipts, to show how much you spent or lost. You can also provide notes or papers you made yourself to explain or support other proof, but those notes or papers alone are not enough to make a valid claim. Your proof or notes should show that your expenses were because of the Data Incident.

Alternative Cash Payment Instead of any other payment or benefits, Class Members may claim a one-time payment of $40.00.

The deadline to submit a Claim Form online or by email is October 27, 2026. If you are mailing your Claim Form, it must be mailed with a postmark date no later than October 27, 2026.
